David Davis was accused of hypocrisy after it emerged that the Brexit Secretary had taken legal advice over preparations by Brussels for a “no deal” British departure from the European Union. 

He consulted Whitehall lawyers on the grounds that the EU’s planning breached Britain’s continuing rights as a member state and could jeopardise companies’ existing contracts. 

Mr Davis revealed his move in a letter to Theresa May obtained by the Financial Times.
