The executors of Nelson Mandela's estate will oppose his former wife Winnie Madikizela-Mandela in court over the ownership of his Qunu home.
Deputy Chief Justice Dikgang Moseneke, advocate George Bizos and Eastern Cape Judge President Themba Sangoni are the executors of the former president's estate.
Madikizela-Mandela earlier this year challenged the ownership of her former husband's Qunu home after she was left out of his will following his death in December last year. She claims that she had owned the Qunu land but Mandela had registered it in his name without her knowledge and that this was unlawful.
Moseneke said on Monday that the executors had decided to oppose Madikizela-Mandela in court after an attempt to reach an amicable solution out of court had failed.
"In effect, the claim seeks to undermine or alter the last will and testament of the late Nelson Rolihlahla Mandela. To that extent, the Executors are obliged to defend the validity of the will and the wishes of the testator," Moseneke was quoted as saying by eNCA.
"The joint attorneys of the Executors have been instructed to file the necessary notice of opposition with the Registrar of the High Court, Mthatha and to brief counsel to prepare the necessary opposition papers," Moseneke said.
In his will, Mandela said that the Qunu home was to be used as a family home by that could be used by his family and his widow Graca Machel's family.
President Jacob Zuma has also decided to oppose Madikizela-Mandela in court.
